This agreement is made and entered into by and between Drachten Performance LLC ("seller") and the person listed below ("buyer"), for the purpose of setting forth the terms and conditions of purchase buy the buyer of a purebred AKC/UKC registered Labrador Retriever from the litter whelped as listed below.
For $1200 ($300 nonrefundable deposit included), the seller agrees to sell and the buyer agrees to purchase the following puppy from the litter described below subject to the following terms:

Seller warrants that the above described dog is a purebred Labrador Retriever registerable/registered with the American Kennel Club (AKC) and United Kennel Club (UKC) and that AKC and UKC registration papers will be delivered and/or transferred to the Buyer’s name on or before __October 1, 2018____, together with a copy of its pedigree. Registration papers will be filled out at the time of dog pickup. The breeder will then mail papers to any applicable co-breeders and on to the appropriate registries. The registries will mail the papers directly to the new owners at that time. Seller may elect to register the puppy via online registry processes whenever possible.
Seller warrants that the above-described dog is in good health at the time Buyer assumes ownership. Buyer agrees to have the dog examined by a licensed Veterinarian within two (2) days of receipt of dog if they so choose.
**Puppies may come into contact with many types of bacteria and other organisms (such as Coccidiosis and Giardia) that may not appear until the puppy is stressed while orienting to a new home. These are easily treatable conditions and are not covered under the health guarantee.
If, as a result of the examination, the veterinarian determines that the dog is not in good or treatable health then the Buyer shall elect to keep the dog or return the dog to the Seller for a refund. If the buyer elects to return the dog, Buyer shall, within 10 days after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian's certificate stating that the dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the dog to Sellers at Buyers expense. Upon receipt of the dog, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the dog only, and further performance under this contract shall be null and void. All action taken to return the dog shall be done with the best interest of the dog in mind including temperature at time of shipment and non-stop flights.
It is understood that breeding any animal is not an exact science, but rather a random assortment of genes determined by nature. Buyer understands that the Labrador Retriever breed as a whole is at risk for various issues such as hip dysplasia. The dogs used in our breeding program are OFA tested with Normal Elbows as well as DNA testing for applicable tests to ensure their status for those diseases to provide the most educated information about all our dogs.
Despite our best efforts, it is impossible to guarantee an animal completely free of all genetic disorders, but we offer a 26 month Eye and Hip Dysplasia Guarantee on all our puppies. Should your puppy fail an official CERF or OFA hip/elbow test, the Buyer is required to contact the Seller with the information and provide a certified veterinary statement detailing the affliction. The Seller reserves the right to get a second opinion as desired. This guarantee is null and void in the event the following happens:
The Buyer may return it to Seller and will receive a replacement dog/dog of like quality from the next available litter, or may keep the dog, which will be spayed or neutered and provided proper treatment (as needed) at the Buyer’s expense and receive a replacement puppy of like quality from the next available litter.
If Buyer chooses a replacement dog AND desires to return the affected puppy/dog, Buyer and Seller shall make prompt arrangements within 10 days of receipt of certified letter and Veterinarian certification for return of the dog sold herein to Sellers place of business. Buyer shall be responsible for taking good and reasonable care of the dog until Seller receives it. Costs and related expenses of returning the dog to Seller shall be the obligation of the Buyer.
Delivery of puppies is NOT available. Buyers are required to pick up their puppy from us or arrange their own transportation as per USDA/APHIS rules.
Buyers are required to choose their puppy prior to the puppy's 8th week and pick them up during weeks 8 and 9 of age. Puppies not picked up by 9 weeks of age will be held for a maximum of 10 days at a board rate of $20 per day. At this point, the puppy will be considered "abandoned" and relisted for sale. No monies will be returned to buyer in the event this happens.
Puppy Selection Guidelines
When choosing puppies, Drachten will make recommendations based on our extensive puppy program. The buyers of puppies in the litter will choose their puppies based on the order they placed deposits by sex/color. If a buyer with a paid deposit does not make a selection of a puppy in their pick order within 48 hours of being notified, Drachten reserves the right to move to the next person on the list and offer them their pick to ensure that the selection process is as efficient as possible. When the skipped person gets in contact, if the pick they selected is still available, they will be allowed to get that one. In the event their chosen puppy has been chosen due to defaulting on responding in a timely manner, they will be asked to select another puppy and given 24 hours to respond/make a selection and so on.
Seller shall provide Buyer with AKC/UKC Limited Registration Certificate. This does not limit the animal in any way from competing in any events except conformation. Nonbreeding animals must be spayed or neutered no later than 18 months of age. Registered name preferences need to be submitted no later than 5 weeks of age and in compliance with Kennel guidelines as discussed individually. Unless otherwise noted, the puppy shall carry the "Drachten" kennel name and the name shall be in compliance with the litter theme should there be one. After 5 weeks of age, the registered names will be assigned. Any puppies without submitted names will be named by Drachten.
If you wish to be eligible for Full registration of your dog, you must complete the following additional steps:
Obtain at a minimum ONE qualifying title/title combination as follows:
Once a qualifying title from above AND the Health Clearances as listed are obtained, Drachten Performance will release the AKC/UKC papers for this puppy as Full Registration. Please submit proof of these titles and health certificates electronically to Drachten once you wish to gain Full Registration. We will process the AKC/UKC papers to revoke the Limited status. This process is considered null and void if the dog is bred prior to meeting these steps.
Buyer agrees that he/she is not acting as an agent in the purchase or this dog and that Buyer will not sell this dog or its progeny to any agent, pet store or guard dog business.
Buyer agrees that if it becomes necessary to return this dog, Buyer will return (at their expense) the dog to the Breeder only. Friends and family are not eligible to take possession of the dog. Only persons listed as the co-owner on the AKC paperwork shall be owners of the dog and must be included in this contract.
Buyer agrees that the dog will reside at the home of the Buyer, have access to a fenced yard and/or be under physical/verbal control of someone actively supervising during exercise times, not be chained or tethered out as a means of containment, and will be provided with proper housing, a good high quality diet (Pro Plan or better is recommended), annual shots, proper grooming, and exercise. Buyer also agrees that this dog will not be used as a guard dog for any business. Buyer agrees that at least one basic obedience training course (or CGC/RN/CD title obtained) will be completed with the dog.
This Agreement is made and signed by both parties to insure the well being and protection of this dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations under this Agreement and the dog must be returned to the Breeder. Any legal action/needs will take place in Brazos County, Texas.
Balance owed can be paid at any time prior to picking up puppy. If paying by check, it MUST be received no sooner than 2 weeks prior to pick up date. Online payment via our website or Zelle is strongly preferred. Exact cash payment is accepted at pickup as well.

This Agreement may be executed by providing an electronic signature under the terms of the Electronic Signatures Act, 15 U.S.C. SS 7001 et. seq., and may not be denied legal effect solely because it is in electronic form or permits the completion of the business transaction referenced herein electronically instead of in person.
