Terms & Conditions
Please read the following booking conditions carefully as they set out the terms and conditions of the contract between you and SA Cruises. We act as booking agents for the suppliers of the component parts of the holidays we organise, and as such, bookings for their services will form a direct contract between you and the relevant supplier and will be subject to that suppliers’ standard terms and conditions.
Bookings
The booking confirmation in the normal course is only open for acceptance by you for a period of 72 hours after the date on which the confirmation was sent to you. A non-refundable deposit of R3000 per cabin is required to be received within 72 hours of the booking confirmation. The balance of payment is required no later than 75 days before your scheduled departure. This is reduced to immediate payment in full when bookings are made within 75 days of sailing. Failure to pay on time will result in the automatic cancellation of your booking.
Price and Availability
The costs associated with travel arrangements are not stable and currency fluctuations are not able to be predicted.
All bookings remain subject to currency fluctuation until the full package price has been paid to SA Cruises. Any surcharges in the currency will result in your cruise being adjusted to accommodate any sharp currency fluctuations, and/or increases in fuel charges, and taxes such as port charges
- Prices are quoted in SA Rands
- All quotations are subject to availability from the suppliers
- Payment of the deposit does not secure a price and bookings remain subject to currency fluctuation until the full package price has been received by SA Cruises
SA Cruises may from time to time offer once-off promotional fares, packages, or add-on discounted benefits for the purpose of selling unsold berths, usually closer towards the departure date of a particular cruise. No cruise booking already made, whether the deposit has already been paid or not, may be transferred or exchanged for a Cruise booking relying on such promotional fares or packages
Cancellation or Changes
SA Cruises is to be notified in writing of any cancellation or request to make changes to a booking. Charges will be determined at the time of cancellation/ amendment and the below indicates the maximum charges that can be imposed.
The First names / surname / dates of birth and gender of each passenger being booked is to be correct at the time of the booking request and must match the passenger’s passport. No bookings with “Nicknames” / duplicate names or names to be advised will be permitted
- Any change to the names in which the booking is made: R600 per name up until 3 days before sailing; R1 200 Per name change from 3 days before sailing
- R3000 Deposit is 100% non-refundable and not transferrable
- Cancellation 75-40days before sailing – 50% of the cruise fare is forfeited
- Less than 40 days before sailing – 100% of the cruise fare is forfeited
An amendment fee of R350 will be charged for each change requested to be made to a confirmed booking, (in addition to any cancellation charges which may be applicable)
Cruise Bookings are not transferrable and my not be traded.
Travel Insurance
Mandatory cruise insurance is included in your cruise fares, and we strongly suggest that any passenger with any pre-existing illnesses contact the insurance company directly to check their cover provided.
Passports and travel documents
The onus rests on the passenger to ensure that all their travel documents are in order. SA Cruises will not be held liable for any loss should a passenger not have obtained the correct travel documentation. Passports are required to be valid for 6 months after return to South Africa. It is the passengers’ responsibility to check visa requirements with the consulate or embassy of each country being visited.
Force Majeure
SA cruises cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any damage or loss, resulting from a “force majeure”. In these Booking conditions “force majeure” means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events include war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
Travelling with Children - From 01 June 2015, all children under the age of 18 require the following to travel:
- Valid passport to travel internationally in and out of SA
- Unabridged birth certificates to travel internationally in and out of SA
- If travelling with 1 parent, consent in the form of an affidavit of the other parent is required as well as an unabridged birth certificate and valid passport
- If travelling with neither parent (ie: friends / grandparents / other family members), consent in the form of an affidavit of the other parent is required as well as an unabridged birth certificate and valid passport

Feedback
If you experience any problems with your holiday whilst away, you must immediately inform the supplier of the service in question. If you are still dissatisfied, you must notify SA Cruises immediately to enable us to solve the problem. SA Cruises will only consider claims if the dissatisfaction with your travel booking has been brought to our attention immediately, giving us the opportunity to resolve the problem.
Whilst every effort is made to resolve your complaint to your satisfaction, it is specifically recorded that SA Cruises in no way accepts liability for any claim.
Privacy Policy
SA Cruises is committed to protecting your personal information and agree to handle your personal information in accordance with legislation.
Responsibility and limitation of Liability
Although the travel services are provided by reputable service providers, SA Cruises has no control over the way in which the service providers perform the services, and so SA Cruises is not liable for any loss, damage, injury, accident, delay, or any other irregularity howsoever arising. This means that you will have to claim directly against the service provider for any such loss or damage which you suffer. Should any travel component be confirmed by SA Cruises and this component is cancelled by the supplier for whatsoever reason, then in such instances SA Cruises is liable to refund only the monies received by SA Cruises on your behalf and shall not be liable for the payment of any form of compensation for the cancelled services.
Jurisdiction of the Magistrates Court
SA Cruises shall be entitled, at its option to institute any legal proceedings arising out of or in connection with this contract in any Magistrate’s Court having jurisdiction in terms of Section 29 of the Magistrate’s Court Act No 32/1944 as amended, notwithstanding that the amount in issue may exceed the limits of such jurisdiction.
Legal
This document together with the Booking Form, Invoice and itinerary constitutes the sole record of the agreement between the parties. No party shall be bound by any representation, warranty, and promise of the like not recorded herein. All costs and disbursements, including legal costs on the attorney and client scale incurred by SA Cruises in recovering any damages and payments payable by the passenger to SA Cruises shall be for the passengers account. This agreement shall in all respects be governed by and construed in accordance with the laws of the Republic of South Africa. The passenger hereby consents to the jurisdiction of the Magistrates Court having jurisdiction over its person in respect of all proceedings in connection with this agreement.
Acceptance
I acknowledge that I am 18 (eighteen) years of age or older and that I understand and have the legal capacity to enter into this contract and have understood, agree with and have accepted these terms & conditions.
